The Confederation of National Chambers of Commerce, Services and Tourism (Concanaco Servytur México) recognized the openness of the Government of Mexico and the Ministry of Labor and Social Welfare (STPS) to move towards responsible labor reformflexible and gradual, that considers the operational realities of millions of family businesses.

From the beginning of the discussion, the Confederation warned about the risks of an abrupt reduction in the working day without accompanying mechanisms. Even with reservations about the pace of the reform, the organization decided to remain in the technical and institutional dialogue, which, it stated, allowed its concerns to be taken into account.

“Today we see that the sector’s concerns were heard and are reflected in the implementation route presented this morning,” said Octavio de la Torre, president of Concanaco Servytur.

40-hour labor reform and increase in the minimum wage announced

During the morning conference of the President of the Republic, Claudia Sheinbaum, accompanied by the head of the STPS, Marath Bolaños, the new route to apply the reform regarding working hours, as well as the increase in the minimum wage, was announced. In this context, a differentiated adjustment for the northern border was also confirmed in order to preserve regional competitiveness.

Throughout technical tables, Concanaco presented proposals that were integrated into the final legal framework. Among the main advances, the following stand out:

  • Gradual application with entry into force in January 2027.
  • A mandatory weekly rest day, without affecting sectors that operate on weekends.
  • Extension of the overtime limit from 9 to 12 per week, distributed over up to four days.
  • Regulation of the use of triple hours, eliminating its use as a daily practice.
  • Greater flexibility in the distribution of the day, allowing up to 56 hours per week (ordinary hours + 12 extra hours + 4 additional hours by voluntary agreement).
  • More precise definition of behaviors related to human trafficking in the workplace.
  • Direct negotiation between employer and worker to define the working day, without exceeding 12 hours per day.
  • Obligation to electronically control working hours, with a special regime for MSMEs.
  • Legal recognition of the hour bank and the compacted day, equating them to hourly payment.
  • Increase in the minimum wage with a differentiated scheme for the northern border.
